The Texas rules behind these dates
- Subcontractors and suppliers (anyone not hired by the owner): for each month of unpaid labor or materials, send a Notice of Claim for Unpaid Labor or Materials to the owner and the original contractor by the 15th day of the 3rd month after that month. On a residential construction project, it is the 15th day of the 2nd month. § 53.056(a-1).
- Lien affidavit for a subcontractor or supplier: filed with the county clerk by the 15th day of the 4th month after the month of the last labor or materials (3rd month on residential). § 53.052.
- These rules are for original contracts entered into on or after January 1, 2022. HB 2237 changed chapter 53 on that date, and older original contracts stay under the old law (HB 2237, sec. 37).
- Notices go in person, by certified mail, or by a traceable private delivery service. If a deadline lands on a Saturday, Sunday, or legal holiday, it moves to the next day that is not one. § 53.003.
